Why can't you see the ignorant one

In the place created by truth

You can't follow the path of truth

With the hearts of those who follow

Never make fun of those who know the way on the path

Don't be wise and talk

Never take note of beautiful people

Of course there is a miracle in one

Brother holds on tightly to brother

Pearl purple has a beautiful scent

Look at these stars, the moon, the sun

Understand when you look at the sky

Those who escape from knowledge remain on the path

All calamities are based on it

Love and believe without seeing God

Other than you, the wise are blind

The one who provides unity with beautiful words

The scholar is the one who does not stay away from knowledge

The one who sets his heart on the path of truth

As a humming bee brings smile to bunch of white lilies

Why don't you beam in the huge garden of my heart

The spring from heaven drops with dream with your charm

Near the horizon where the clouds drift away out of sight

The way we used to soar in the deep blue sky

Why don't you glide in my dream with your charm

The glittering moon shines in the dark night

But you are not shining this gloomy day in my life

I am like a lonely bird without companion

Come down to the desolation of my barren earth.

THE DUST OF GRIEF !

At times I think of my uneventful life

Just a garland of thorns sans peace

What I have found is the dust of grief

When I did desire for the cold touch

Out of nothing only cold sigh in my lot Sorrows made my heart more sombre

You left leaving a couple of moments

None has time to hold my numb hands

Even my shadow is very often apathetic

This is my life and why should I be afraid Of sorrow for it's mine, my companion.

I 'll give away my life , even lose all my wins

Whatever be the cost, you're my everything

Beyond all my limits and boundaries

Now I'm broken after giving everything

I'm no one ; you 've become my destination

Great things God has given without asking

Otherwise atheists like me won't get God

My desires 've met you as you became my prayer.

The morning star you are in my life

Beaming brightly in the darkest world

You often arouse the bizarre stir in me

Of flustered fog in the face of rising sun

You venture out with your daring glint

Like a musky muse in face of darkness

As if mystifying mind of a blushing lotus

Set a swarm of bees ablaze in horizon

With your effervescent amorous prayer

Your radiance melts away all afflictions

With the glistening glow amid dimness

You do shower light into my empty eyes.

"The Bewitching Hour"

Deep in the dark of night

Lying awake

Your image burned into my imagination

Eyes closed as dreams of you descend like warmth deep in the cold of winter

As the bewitching hour approaches thoughts flash back to our first meeting

When universes collided that fateful day

Recalling the mysteriousness of it all

I smile

Then hearing a whisper

Urging me to write a poem

Honoring the great gift of generosity given to me

A gratuitous offering made by the heavens

Let a million twinkling stars bear witness to our joy

Our gratitude to a kind universe

As sunlight rises over the horizon

Thoughts turn to love's enigmatic nature

Suddenly I experience a compelling urge to dance

With my back to the wind

Serenade clouds

Hiding smiling angels

Listening closely hearing their joyful sound

Harmonizing the last note of your name

Then I pray my urgent prayer that angels sing my name to you

Sweet melodious music lifting you to the mountain top

Where I impatiently wait your coming

My beating heart speaks only to your eyes

Your love is my buoy

Let my name be yours

I am the poet who lives in you

And you

My love

Poem - A Cuckoo

A Cuckoo

Wind blew from North, South East, West,

Dusk enveloped the entire forest,

I was lost in whispers by the fountain,

There, I saw a cuckoo on top of mountain,

Aha! I tried to touch him cooly cooly,

But, he flew away slowly slowly.

Eyes were round and body was inky black,

He did not look woeful,worry and slack.

Always remained himself neat and clean,

Drank fresh water,

Ate fruit and bean.

Mind was full of lovely imagination,

He was his example in new Creation.

Flew slow and fast on his strong wings,

Very skillfully and beautifully he sings.

There was Such a melodiness in his sound,

The listeners were stunned all around.

Supported the oppressed and hated oppression,

In case of unintentional mistake,make a concession.

Did not suffer in any misconception

Against dishonesty,disorder and corruption.

Built his nest on tree near the stream,

Used to see peaceful and sweet dream.

He lived his life with purity and piety,

Savior of peace and tranquility in society.

Dr.Muhammad Ishaq Abbasi (Islamabad, KAHUTA,Pakistan)

He is a world recognized poet and writer. He was born on Monday November 16,1975 in village Khuian tehsil kahuta Pakistan. He writes in English languages. He has written most of the poems on the subject of Nature and peace. He is working as a teacher by profession. He has won prominent position many times in poetry competitions.He is an active member of various literary and creative platforms. His writings are part of several international and national magazines, journals, anthologies and newspapers. He has won many awards in his write ups and ,When he was three years old,his mother fell into a ravine and was hospitalized for six months before dying.

The journey from childhood to adolescence was spent without the wings of a mother, which is difficult to describe in words. And also raise his voice through pen for peace in the world..

Full of the Smell of Sunshine

On the first floor, the balcony

Covered by a few clusters of banana trees all year round

It’s hard to see the sun

It’s his little trick again

The underpants that can’t be exposed to the sun

Rows of colorful flowers

Flower butterflies

Are flying on the window bars!

At my fingertips, dry and cool

Full of the smell of sunshine...

Love is a wonderful thing one can feel

It is sweet even with pain, nothing can heal

Love is the deep blue sea full of tears

It helps you to conquer fears.

Love is like a mountain tree of pine

It has that sweet scent like that of vine

Love is like a precious gemstone

It produces hardships as it is grown.

Love is a kind of sickness which has no cure

The one who experience it is pure

Love teaches human the way to live

A lot of sacrifices and happiness

He survives.

Love is the garden of death

It is a debt one pays for every breath

Love is a wild storm full of destruction

The one who is involved can't follow any instruction.

Love is a sweet and wild passion

It has become today’s world fashion

The true lover’s soul seems to be dead

It is counterfeited and taken over the lover's head.

Love is a feeling of affection and possession

Lover’s heart keeps its impression

Love is a fire that burns the heart

It is sincerely felt when a beloved goes apart.

In a garden, bright with morning dew,

A caterpillar crawls, its world so new.

With every leaf it nibbles through,

It dreams of skies, of endless blue.

Wrapped in silk, it takes its rest,

A quiet cocoon, a hidden nest.

Change is slow, but it’s for the best,

For life’s true beauty is often a test.

Then one day, with wings unfurled,

A butterfly emerges, a new world.

Colors vivid, wings gently swirled,

A symbol of life’s journey, now twirled.

From flower to flower, it dances light,

A testament to growth, to reaching new height.

In every flutter, in every flight,

It whispers of hope, of endless might.

Let us learn from this gentle creature,

Life’s constant change, its every feature.

In every stage, in every future,

We find our strength, our inner teacher, our healer.

বাংলাদেশের কোটা আন্দোলন ও কিছু আনুষঙ্গিক কথা

অবিভক্ত বাংলার রক্তক্ষয়ী আন্দোলনের একটা ইতিহাস ছিল।১৯৪৭ সালে ভারত তথা বঙ্গবিভাজনের পর থেকে পূর্ববঙ্গে সেই পরম্পরার প্রকাশ ঘটতে দেখা যায়। পূর্ববঙ্গের ভাষা আন্দোলন বিশ্ববাসীকে ১৯৫২ সালে এক রক্তস্নাত ২১শে ফেব্রুয়ারি উপহার দেয় যা ২০০০ সাল থেকে আন্তর্জাতিক মাতৃভাষা দিবস হিসেবে উদযাপিত হচ্ছে।ভাষা আন্দোলনের ধারাবাহিকতায় ১৯৭১ সালে পূর্ববঙ্গের মুক্তিযুদ্ধে ৩০ লক্ষ মানুষের প্রাণহানির মধ্য দিয়ে নতুন দেশ বাংলাদেশ সৃষ্টি হয়। স্বাধীনতা লাভের পর বিগত অর্ধ শতাধিক বছরে বহুবার বাংলাদেশের রাজপথকে রক্তাক্ত আন্দোলনে ব্যস্ত হতে দেখা গেছে। ২০২৪ সালের 'বৈষম্যবিরোধী ছাত্র আন্দোলন' স্বাধীন বাংলাদেশের সর্বাধিক সহিংস আন্দোলন হিসেবে চিহ্নিত হতে পারে।

১৯৭১ সালের ডিসেম্বর মাসে স্বাধীনতা লাভের পর বঙ্গবন্ধু শেখ মুজিবুর রহমানের নেতৃত্বাধীন আওয়ামী লীগ সরকার ১৯৭২ সালেই সরকারি চাকরিতে সংরক্ষণ প্রথা প্রবর্তন করে। সংরক্ষিত আসন সংখ্যার শতাংশ নির্ধারিত হয় এরূপ: মুক্তিযোদ্ধা-৩০, নারী-১০, জেলা-১০, জনজাতি-৫, প্রতিবন্ধী-১, মোট ৫৬ শতাংশ। ১৯৭৫ সালে বঙ্গবন্ধুর হত্যাকাণ্ডের পর দুই দশক ধরে এই সংরক্ষণ বা কোটা স্থগিত রাখা হয়। ১৯৯৬ সালে বঙ্গবন্ধুর কন্যা শেখ হাসিনা বাংলাদেশের প্রধানমন্ত্রী হন এবং সরকারি চাকরিতে কোটা পদ্ধতি পুনঃপ্রবর্তন করেন। মুক্তিযোদ্ধা থেকে মুক্তিযোদ্ধার সন্তান পর্যন্ত কোটা সম্প্রসারিত করা হয়। ২০০১ সালে বিএনপি নেত্রী বেগম খালেদা জিয়া প্রধানমন্ত্রী হয়ে কোটা প্রথা রদ করেন। ২০০৯ সালে শেখ হাসিনা শাসন ক্ষমতায় ফিরে আসেন এবং সেই সঙ্গে ফিরিয়ে আনা হয় সংরক্ষণ। ২০১১ সালে মুক্তিযোদ্ধাদের নাতি-নাতনিদেরও সংরক্ষণের আওতায় আনা হয়।২০১৮ সালে কোটা সংস্কারের তীব্র আন্দোলনের পরিপ্রেক্ষিতে হাসিনা সরকার জনজাতির জন্য ৫ শতাংশ ও প্রতিবন্ধীদের জন্য ১ শতাংশ সংরক্ষণ বজায় রেখে বাকি ক্ষেত্রগুলো থেকে সংরক্ষণ তুলে দেয়। ২০২১ সালে মুক্তিযোদ্ধা কোটা বাতিলের বিরুদ্ধে হাইকোর্টে মামলা করা হয়। ২০২৪ সালের ৫ই জুন হাইকোর্ট মুক্তিযোদ্ধা কোটা পুনর্বহালের পক্ষে রায় দেয়। এর প্রতিবাদে ছাত্র সমাজ পথে নামে। আবার কোটা সংস্কারের দাবি ওঠে।সরকারের পক্ষ থেকে প্রাথমিক ভাবে বলা হয় যে, আদালতের রায় নিয়ে সরকারের কিছু করার নেই। কিন্তু আন্দোলনের চাপে পড়ে সরকার হাইকোর্টের রায়ের বিরুদ্ধে সুপ্রিম কোর্টের আপিল বিভাগে আবেদন করে। সুপ্রিম কোর্ট ১০ই জুলাই হাইকোর্টের রায়ে স্থগিতাদেশ দিয়ে ৭ই আগস্ট পরবর্তী শুনানির দিন ধার্য করে। ১৪ই জুলাই প্রধানমন্ত্রী শেখ হাসিনা একটা অনুষ্ঠানে আন্দোলনকারীদের খুব কড়া ভাষায় সমালোচনা করার পাশাপাশি বলেন যে, সংরক্ষণ মুক্তিযোদ্ধাদের নাতি-নাতনিরা পাবে না তো কি রাজাকারদের নাতিপুতিরা পাবে? তাঁর এই মন্তব্য আগুনে ঘি ঢালার সামিল হয়।আন্দোলনকারীরা তীব্র অসন্তোষ ব্যক্ত করে স্লোগান দেয়, "চাইতে গেলাম অধিকার, হয়ে গেলাম রাজাকার! তুই কে? আমি কে? রাজাকার রাজাকার! বলছে কে? বলছে কে? স্বৈরাচার স্বৈরাচার!" আন্দোলন ভয়ঙ্কর রূপ ধারণ করে। সুপ্রিম কোর্টে কোটা মামলার শুনানি এগিয়ে আনা হয়। ২১শে জুলাই সুপ্রিম কোর্ট সরকারি চাকরিতে সাত শতাংশ কোটা রাখার কথা জানায়- মুক্তিযোদ্ধা পরিবারের জন্য ৫ শতাংশ, ক্ষুদ্র নৃগোষ্ঠীর জন্য ১ শতাংশ, প্রতিবন্ধী ও তৃতীয় লিঙ্গের জন্য ১ শতাংশ। সুপ্রিম কোর্টের রায়কে মান্যতা দিয়ে হাসিনা সরকার ২৩শে জুলাই প্রজ্ঞাপন জারি করে। কিন্তু সাত-আট দিনের আন্দোলনেই বাংলাদেশ কার্যত রণক্ষেত্র হয়ে ওঠে। সকল সরকারি ও বেসরকারি শিক্ষা প্রতিষ্ঠানে অনির্দিষ্টকালের জন্য ছুটি ঘোষণা করা হয়। আবাসিক হলগুলো থেকে পড়ুয়াদের বের করে দেওয়া হয়।ভারত, নেপাল ও ভুটানের শিক্ষার্থীরা স্বদেশে ফিরে যান।গোলাগুলি, লাঠালাঠি, ইটপাটকেল ছোড়াছুড়িতে কমবেশি দুশো জন ছাত্র, পুলিশ ও সাধারণ মানুষ নিহত এবং দু'হাজার জন আহত হন। ভাঙচুর ও অগ্নিসংযোগের মাধ্যমে রীতিমতো ধ্বংসযজ্ঞ চালানো হয়। প্রচুরসংখ্যক সরকারি বেসরকারি প্রতিষ্ঠান, স্থাপনা ও যানবাহনের ব্যাপক ক্ষতিসাধন করা হয়। তাণ্ডবের শিকার হয় রাজধানীর মেট্রোরেল, টোল প্লাজা, টিভি'র কার্যালয়, ইন্টারনেটের কার্যালয়, ফায়ার সার্ভিস স্টেশন, হাসপাতাল, কমিউনিটি সেন্টার। একটা জেলে হামলা চালিয়ে আটশো'র বেশি বন্দীকে মুক্ত করে দেওয়া হয়।পরিস্থিতি সামাল দিতে কারফিউ জারি করা হয়, সেনা নামানো হয়, দেখা মাত্র গুলি করার নির্দেশ দেওয়া হয়।

বাংলাদেশে সরকারি চাকরির প্রধান পরীক্ষা বিসিএস বা বাংলাদেশ সিভিল সার্ভিস। এটা একটা ত্রিস্তরীয় পরীক্ষা যা সম্পন্ন হতে প্রায় দুই বছর সময় লাগে। প্রথম পর্যায়ে প্রিলিমিনারি পরীক্ষা নেওয়া হয়। এখানে যারা কোয়ালিফাই করে তারা দ্বিতীয় পর্যায়ে লিখিত পরীক্ষায় বসে। এই মূল পরীক্ষায় যারা উত্তীর্ণ হয় তাদের তৃতীয় পর্যায়ে সাক্ষাৎকার বা মৌখিক পরীক্ষায় ডাকা হয়। বিসিএস পরীক্ষায় চূড়ান্ত সাফল্যের হার মাত্র দুই শতাংশের মতো। এই পরীক্ষার কোনো পর্যায়েই চাকরিপ্রার্থীদের কোটাগত সুবিধা পাওয়ার সুযোগ নেই। সুতরাং, চাকরির মেধা তালিকায় সত্যিকারের মেধাবী ছেলেমেয়েরাই ঠাঁই পায়। এজন্য কোটায় চাকরি প্রাপকরা একেবারে নিম্ন মেধার অথবা অযোগ্য, এমন মনে করা সঙ্গত নয়। ১৭ কোটি জনসংখ্যার বাংলাদেশে এখন সরকারি চাকরিতে ১৭ লক্ষ আসন রয়েছে। মুক্তিযোদ্ধাদের সংখ্যা মোট জনসংখ্যার এক শতাংশের কম। এদিক থেকে দেখলে দেশের এক শতাংশেরও কম মানুষের জন্য চাকরিতে ৩০ শতাংশ সংরক্ষণ অস্বাভাবিক বলেই মনে হয়।

বাংলাদেশের রাজনীতি ও আন্দোলনে দুটি বহুল ব্যবহৃত শব্দ হলো মুক্তিযোদ্ধা ও রাজাকার। ইংরেজি 'ফ্রিডম ফাইটার' পশ্চিমবঙ্গে 'স্বাধীনতা সংগ্রামী' হলেও বাংলাদেশে 'মুক্তিযোদ্ধা'। তবে ভারতের স্বাধীনতা সংগ্রাম ও বাংলাদেশের মুক্তিযুদ্ধের মধ্যে একটুখানি ফারাক আছে। ভারতের স্বাধীনতা সংগ্রাম অহিংস ও সহিংস উভয় পথেই পরিচালিত হয়েছে। কিন্তু পূর্ব পাকিস্তানের মুক্তিযুদ্ধ ছিল পুরোপুরি সহিংস। ভারতের স্বাধীনতা আন্দোলন কয়েক দশক ধরে চললেও বাংলাদেশের মুক্তিযুদ্ধ মূলত ১৯৭১ সালের মার্চ থেকে ডিসেম্বর পর্যন্ত চলেছিল। ১৯৭২ সালে ঘোষিত দ্য বাংলাদেশ ফ্রিডম ফাইটারস ওয়েলফেয়ার ট্রাস্টের সংজ্ঞা অনুযায়ী, মুক্তিযোদ্ধা হলেন এমন একজন ব্যক্তি যিনি মুক্তিযুদ্ধে নিয়োজিত যেকোনো সংগঠিত ফোর্স বা দলের সদস্য হিসেবে সক্রিয় ভূমিকা রেখেছেন। কেউ যদি মুক্তিযুদ্ধে নিয়োজিত কোনো সংগঠিত দলের সদস্য না হন অথবা হয়েও সক্রিয় ভূমিকা না রাখেন তবে তিনি মুক্তিযোদ্ধা হিসেবে বিবেচিত হবেন না। শাসকদলের পরিবর্তনের সঙ্গে সঙ্গে অবশ্য মুক্তিযোদ্ধার সংজ্ঞাতেও পরিবর্তন ঘটতে দেখা গেছে। মুক্তিযোদ্ধাদের একাধিক তালিকা প্রণয়ন ও প্রকাশ করা হয়েছে কিন্তু সেসব তালিকা নিয়ে অনিয়মের অভিযোগ উঠেছে এবং বিতর্কের অবসান হয়নি। আওয়ামী লীগ সরকারের একটি হিসাব অনুযায়ী মুক্তিযোদ্ধার সর্বোচ্চ সংখ্যা এক লাখ তিরাশি হাজার। এখন হয়তো বেঁচে আছেন এক লাখ এবং তাঁদের সকলেরই সরকারি চাকরি পাওয়ার বয়স পার হয়ে গেছে। মুক্তিযোদ্ধাদের ছেলেমেয়েদেরও অধিকাংশের বয়স পার হওয়ার মুখে। এখন তাঁদের নাতিপুতিরা কোটার সুবিধা ভোগ করেন।

১৯৭১ সালে পূর্ব পাকিস্তানে মুক্তিযুদ্ধের নেতৃত্ব দিয়েছিল আওয়ামী লীগ। কিন্তু আওয়ামী লীগের বিরোধীদের একটা অংশ পাকিস্তান থেকে বিচ্ছিন্ন হয়ে পৃথক রাষ্ট্র গঠনের পক্ষে ছিল না। পাকিস্তানের সেনাবাহিনীর প্রত্যক্ষ মদতে পাকিস্তানপন্থী বাঙালি এবং উর্দুভাষী অবাঙালি অভিবাসীদের নিয়ে '৭১ সালের মে মাসে খুলনায় গঠিত আধা সামরিক বাহিনী রাজাকার নামে পরিচিত হয়। রাজাকাররা পাক সামরিক বাহিনীকে বাংলাদেশে গণহত্যা, ধর্ষণ ও অগ্নিসংযোগের মতো দুষ্কর্মে সহায়তা করেছিল। বাংলাদেশের স্বাধীনতা লাভের পর রাজাকারদের অনেকেই দেশ ছেড়ে পালায়।বিগত এক দশকে বাংলাদেশে বেশ কয়েকজন রাজাকারের মৃত্যুদণ্ড কার্যকর হতে দেখা গেছে। প্রসঙ্গত উল্লেখ্য, ফার্সি রেজাকার শব্দের অর্থ হলো স্বেচ্ছাসেবক। রেজাকার অপভ্রংশে হয়েছে রাজাকার। বাংলাদেশে রাজাকার একটি অপমানসূচক শব্দ যার অর্থ বিশ্বাসঘাতক, প্রতারক বা দেশদ্রোহী।আল বদর ও আল শামস নামে আরও দুটি আধা সামরিক বাহিনী পূর্ব পাকিস্তানের মুক্তিযুদ্ধের বিরোধিতা করেছিল। রাজাকার, আল বদর ও আল শামস বাহিনীর প্রায় এগারো হাজার জনের একটি তালিকা ২০১৯ সালের ডিসেম্বর মাসে সরকার প্রকাশ করলেও নানা ভুল ও অসঙ্গতি ধরা পড়ায় তা শেষ পর্যন্ত প্রত্যাহার করে নেওয়া হয়।

বাংলাদেশের যেকোনো আন্দোলনে ভারত বিদ্বেষী স্লোগান উঠতে দেখা যায়। এবারও আন্দোলনকারীদের মিছিল থেকে আওয়াজ উঠেছে, "ভারত যাদের মামাবাড়ি বাংলা ছাড় তাড়াতাড়ি।" আসলে শেখ হাসিনার সঙ্গে ভারতের সুসম্পর্ককে আওয়ামী লীগ বিরোধী রাজনৈতিক দলগুলো ভালো চোখে দেখে না। তারা অভিযোগ করে যে, হাসিনা ভারতের কথায় চলে। তাদের হাসিনা-বিরোধিতা ভারত-বিরোধিতায় পরিণত হয়।আবার বাংলাদেশে অনেক মুসলিম মৌলবাদী সংগঠন আছে যারা মানসিকভাবে পাকিস্তানপন্থী। এরা সুযোগ পেলেই ভারতবিরোধী বক্তব্য পেশ করে। ক্রিকেট খেলাতে ভারতের পরাজয় ও পাকিস্তানের বিজয় কামনা করে। অনুরূপ কাণ্ডকারখানা অবশ্য ভারতেও ঘটতে দেখা যায়। এদেশের হিন্দুত্ববাদী রাজনৈতিক দল ও সংগঠনগুলো কারণে অকারণে পাকিস্তানের প্রসঙ্গ টেনে আনে। পাকিস্তান ইংল্যান্ডের বিরুদ্ধে জিতলেও তাদের মুখ ভার হয়। যখন তখন বাংলাদেশীদের বিরুদ্ধে ভারতে অনুপ্রবেশের অভিযোগ করা হয়। 'ঘুসপেটিয়া' বলে অপমান করা হয়।

বাংলাদেশের সংসদীয় গণতন্ত্র এখনও যথেষ্ট বিকশিত হয়নি। এবছর জানুয়ারি মাসে টানা চতুর্থবারের মতো শেখ হাসিনার সরকার গঠিত হয়। কিন্তু প্রধান বিরোধী দল বিএনপি এই নির্বাচনে অংশ গ্ৰহণ করেনি। চল্লিশ শতাংশের কম ভোট প্রদত্ত হয়। বিভিন্ন আন্দোলন পরিচালনা ও তা দমন করার ক্ষেত্রে গণতান্ত্রিক ভাবধারার অভাব অনুভূত হচ্ছে। বুক চিতিয়ে দাঁড়ানো ছাত্রকে গুলি করে মেরে ফেলা কোনো সভ্য সমাজের পুলিশের কাজ হতে পারে না।স্বাধীনতার পাঁচ দশক পরেও দেশবাসীকে মুক্তিযোদ্ধা ও রাজাকারের সমর্থক হিসেবে বিভাজিত করা সমীচীন নয়।সাম্প্রতিক ছাত্র আন্দোলনে দুর্বৃত্তদের অনুপ্রবেশের প্রমাণ পাওয়া গেছে। ছাত্র আন্দোলনের নেতৃত্বকে এব্যাপারে সতর্ক থাকতে হবে।সাম্প্রদায়িক ও মৌলবাদীদের বিদ্বেষমূলক বক্তব্যের কারণে প্রতিবেশী রাষ্ট্রের সঙ্গে যাতে সম্পর্ক খারাপ না হয় তার জন্য উভয় দেশের নাগরিক সমাজকে সক্রিয় ভূমিকা পালন করতে হবে।

The hardest thing about growing up

Its watching time takes everyone we love

But what pains more than seeing

Our youth fades in front of our eyes?

Millions live in a dark cage of fear

The fear of old age is an imminent shadow

In the twilight of our quiet rooms

Whispers of death bring silent pains

When the flame of youth begins to wane

When strength starts fading like a setting sun

The bells of old age begin to wail

And the fear of dying presses the heart

“One day we shall all die”

Great speeches about vain lifestyles

As we merry and live in a hurry

Finding solace in short-lived romances

The fear of old age holds many as captives

God’s love is the breaking spell

From the grip of the world’s iron hands

In summer, only sunshine is seen

SALVATION!

TAGHRID BOU MERHI (LEBANON - BRASIL)

Merely half a machine;

And the other half of flesh and clay!

Restlessly sighing according to the alphabet of falling, and descending at the last rung of salvation...

I am at the good faith of nature, an eternal being!

From the braid of the cloud, I harmonize and chant hymns of water springs...

So the deserts of hearts and the wilderness of dreams are quenched...

And the clay is saved and the pages of darkness are folded...

You no longer see me as a vaporous being in the form of smoke...

You no longer see my steps as mere airy traces...

You no longer await the sound of the wind as it rages

With its murmurs above the roof of the hungry and in the mouth of emptiness...

I had to borrow from the mountain its towering rocks

And from the sea its turquoise, its sapphire, and its coral, to stir the dust of mirrors and ask it: Who are you...?

In life’s tangled web, we often find,

Opportunities missed, left behind.

Yet fate weaves its threads, unseen and wise,

Turning loss into blessings in disguise.

We mourned the job that slipped away,

The dream role lost, the sun turned gray.

But hidden in shadows, a brighter path,

A chance to grow, to laugh, to do the math.

Love once bloomed, petals soft and sweet,

Then wilted, leaving hearts incomplete.

But from that ache, resilience grew,

A love more profound, tried and true.

Friends once close, like stars aligned,

Drifted apart, their laughter confined.

Yet new companions emerged, steadfast,

Filling voids, healing wounds from the past.

Ventures crumbled, dreams shattered like glass,

But within the debris, seeds took root, alas!

A phoenix rising, stronger than before,

নতুন ফৌজদারি আইন: উদ্দেশ্য নিয়ে সংশয়

আইন (ল) হল কতকগুলো বিধিবিধান বা নিয়ম-কানুন যা রাষ্ট্র রচনা করে তার নাগরিকদের ক্রিয়াকলাপ নিয়ন্ত্রণ করার উদ্দেশ্যে। নাগরিক যখন তার স্বীকৃত অধিকারের সীমা লংঘন করে তখন আইন ভঙ্গের ঘটনা ঘটে। আবার নাগরিককে তার অধিকার থেকে বঞ্চিত করাও আইন বিরোধী কাজ। এক্ষেত্রে রাষ্ট্র তথা সরকারও অভিযুক্ত হতে পারে। আদালত আইন ভঙ্গকারীকে শাস্তি এবং আইন ভঙ্গের কারণে ক্ষতিগ্রস্ত ব্যক্তি বা প্রতিষ্ঠানকে ক্ষতিপূরণ দেওয়ার নির্দেশ দেয়। আমাদের দেশে আইন মূলত দুই ধরনের- দেওয়ানি (সিভিল) ও ফৌজদারি (ক্রিমিনাল)। দেওয়ানি আইনের অধীনে দুই বা ততোধিক ব্যক্তি বা প্রতিষ্ঠানের মধ্যে সম্পত্তি, অধিকার ও দায়িত্বের প্রশ্নে উদ্ভূত বিরোধ বা মামলার নিষ্পত্তি করা হয়। দেওয়ানির বিষয়ে থানায় অভিযোগ জানানো যায় না। অভিযোগকারীকে সরাসরি আদালতে যেতে হয়। অন্যদিকে, চুরি, ডাকাতি, হামলা, হত্যা, প্রতারণা, লুটপাট, বিস্ফোরণ, ধর্ষণ, অপহরণ, জালিয়াতি প্রভৃতি অপরাধমূলক ঘটনা ফৌজদারি আইনের অন্তর্ভুক্ত। ফৌজদারির বিষয়ে থানা ও আদালত দুই জায়গাতেই অভিযোগ জানানো যায়। ফৌজদারি মামলায় জেল, জরিমানা ও মৃত্যুদণ্ডের শাস্তি হতে পারে।

এতদিন ভারতীয় ফৌজদারি আইনের তিনটি অংশের নাম ছিল- ইন্ডিয়ান পেনাল কোড (১৮৬০), ইন্ডিয়ান এভিডেন্স অ্যাক্ট (১৮৭২) ও কোড অব ক্রিমিনাল প্রসিডিওর (১৯৭৩)। আইপিসি বা ভারতীয় দণ্ডবিধি হল ভারতে সংঘটিত নানান ধরনের অপরাধের বিবরণ ও তাদের শাস্তির বিধান সম্পর্কিত প্রধান আইন। জেল, জরিমানা ও মৃত্যুদণ্ডের রায় আইপিসি'র বিভিন্ন ধারা অনুযায়ী হয়ে থাকে। চালু হবার পর থেকে ব্রিটিশ আমলে তো বটেই স্বাধীন ভারতেও এই বিধির অনেক সংশোধন ও সম্প্রসারণ হয়েছে। বিচার প্রক্রিয়ায় যেকোনো অভিযোগকে সত্য প্রমাণ করা জরুরি।এই কাজটি আইইএ বা ভারতীয় সাক্ষ্য আইন অনুযায়ী করা হয়। সাক্ষ্য আইন স্থির করে দেয়, মামলায় প্রমাণ হিসেবে কোন তথ্য (ফ্যাক্ট) দেওয়া যাবে অথবা যাবে না এবং কে কীভাবে সাক্ষ্য দেবে। সূচনার পর থেকে সামান্য আধুনিকনিকীকরণ ও সংযোজন ছাড়া সাক্ষ্য আইনে বিশেষ পরিবর্তন ঘটেনি।সিআরপিসি বা ফৌজদারি কার্যবিধির প্রধান কাজ হল বিভিন্ন অপরাধের তদন্ত, অনুসন্ধান তথা বিচার প্রক্রিয়ার অভিমুখ নির্ধারণ করা।সিআরপিসি'র নির্ধারিত পথে সমগ্ৰ বিচার প্রক্রিয়া পরিচালিত হয়। সিআরপিসি ফৌজদারি মামলার ব্যাপারে সুপ্রিম কোর্ট, হাইকোর্ট, জেলা ও দায়রা আদালত, জুডিশিয়াল ম্যাজিস্ট্রেট, একজিকিউটিভ ম্যাজিস্ট্রেট, পুলিশ প্রভৃতি প্রতিষ্ঠান ও পদাধিকারীদের ক্ষমতা ও এক্তিয়ার নির্ধারণ করে। বিভিন্ন অপরাধকে শ্রেণিবদ্ধ করে। অর্থাৎ, কোনো অপরাধ জামিনযোগ্য (বেলেবল) নাকি জামিনযোগ্য নয় অথবা আমলযোগ্য (কগনিজেবল) নাকি আমলযোগ্য নয় তা স্থির করে। আদালতে ব্যবহৃত বিভিন্ন ফর্মের বয়ান তৈরি করে। সিআরপিসি গঠন করা হয় ১৮৮২ সালে এবং পুনর্গঠিত হয় ১৮৯৮ সালে। ১৯৭৩ সালে পুনরায় আমূল পরিবর্তন ঘটানো হয়। বিগত পঞ্চাশ বছরে সিআরপিসি অন্তত ১৮বার সংশোধন করা হয়েছে। সংবিধান (কনস্টিটিউশন) দেশের সর্বোচ্চ আইন। মৌলিক কাঠামো বজায় রেখে সেই সংবিধানও শতাধিকবার সংশোধন করা হয়েছে। কাজেই ফৌজদারি আইনে টুকটাক পরিবর্তন ঘটানোর মধ্যে কোনো অস্বাভাবিকতা নেই।

কিন্তু এবার অনেক বাড়াবাড়ি করা হয়েছে। ২০২৩ সালের ২৫শে ডিসেম্বর প্রণীত ও ২০২৪ সালের পয়লা জুলাই প্রবর্তিত নতুন ফৌজদারি আইনে তিনটি অংশের নামই বদলে দেওয়া হয়েছে। আইপিসি, আইইএ ও সিআরপিসি'র নতুন নামকরণ করা হয়েছে যথাক্রমে ভারতীয় ন্যায় সংহিতা (বি এন এস), ভারতীয় সাক্ষ্য অধিনিয়ম (বি এস এ) ও ভারতীয় নাগরিক সুরক্ষা সংহিতা (বি এন এস এস)। ঔপনিবেশিক নাম বাদ দেওয়ার জাতীয়তাবাদী যুক্তির আড়ালে নতুন নামকরণের মধ্যে দেশের প্রধান শাসকদলের সংস্কৃত ও হিন্দি ভাষার প্রতি বিশেষ আগ্ৰহের প্রতিফলন ঘটেছে। নতুন নামে শুধু ভাষা নয় ভাবনারও পরিবর্তন ঘটেছে। আইপিসি'র ইংরেজি 'পেনাল'-এর অর্থ দণ্ড বা শাস্তি। কিন্তু বিএনএস'র 'ন্যায়'-এর ইংরেজি হল জাস্টিস। সিআরপিসি'কে 'কার্যবিধি'র মধ্যে সীমাবদ্ধ না রেখে 'নাগরিক সুরক্ষা' নিশ্চিত করার কথা বলা হয়েছে। আপাতদৃষ্টিতে নতুন নামে নাগরিকদের প্রতি সহানুভূতি প্রকাশ পেলেও সরকার বা শাসকদলের উদ্দেশ্য নিয়ে সংশয় দূর হচ্ছে না। এর কারণ হল, ইতিমধ্যে তাদের 'আচ্ছে দিন', 'সবকা সাথ সবকা বিকাশ', 'খাবো না খেতেও দেবো না' প্রভৃতি সুমধুর ভাষ্যের মর্মান্তিক পরিণতি হতে দেখা গেছে।ফৌজদারি আইনের নতুন নামের ক্ষেত্রেও 'মুখে এক কাজে আর এক' করার অভিসন্ধি রয়েছে বলে মনে হয়।

প্রয়োজন থাক বা না থাক মোদি সরকারের কিছু করে দেখানোর একটা ঝোঁক রয়েছে। ব্রিটিশ আমলের ঐতিহ্যবাহী সংসদ ভবন ভালো অবস্থায় থাকা সত্ত্বেও প্রায় দেড় হাজার কোটি টাকা খরচ করে বিশ্বের বৃহত্তম সংসদ ভবন সেন্ট্রাল ভিস্তা নির্মাণ, গুজরাটের নর্মদায় প্রায় তিন হাজার কোটি টাকা ব্যয়ে সর্দার বল্লভভাই প্যাটেলের বিশ্বের উচ্চতম (১৮৩ মিটার) মূর্তি স্থাপন, গুজরাটের মোতেরা স্টেডিয়ামকে প্রায় সাতশো কোটি ব্যয়ে পুনঃনির্মাণ করে নরেন্দ্র মোদীর নামে বিশ্বের বৃহত্তম স্টেডিয়ামে পরিণত করার মতোই নামধাম পাল্টে দিয়ে নতুন ফৌজদারি আইন প্রণয়ন করে সরকার একটি 'কীর্তি' স্থাপন করতে চেয়েছে। এত ধুমধাম করে যে নতুন আইন প্রণয়ন করা হয়েছে পুরনো আইনে কিছু সংযোজন ও বিয়োজন তথা সংশোধনীর মাধ্যমেও সেই কাজটি করা সম্ভব ছিল। যেমন, আইপিসি'র ২৩টি অধ্যায় (চ্যাপ্টার) ও ৫১১টি ধারা (সেকশন) বিএনএস'তে হয়েছে যথাক্রমে ২০ ও ৩৫৮। আইইএ'র ১১টি অধ্যায় ও ১৬৭টি ধারা বিএসএ'তে হয়েছে যথাক্রমে ১২ ও ১৭০।সিআরপিসি'র ৩৭টি অধ্যায় ও ৪৮৪টি ধারা বিএনএসএস'তে হয়েছে যথাক্রমে ৩৯ ও ৫৩১। অপরাধের সংজ্ঞা ও শাস্তি একই থাকলেও বদল করা হয়েছে ধারা নম্বর। যেমন, হত্যার শাস্তির ধারা ছিল ৩০২, হয়েছে ১০৩। হত্যার চেষ্টা ৩০৭ থেকে ১০৯, ধর্ষণ ৩৭৫ থেকে ৬৩, শ্লীলতাহানি ৩৫৪ থেকে ৭৪, প্রতারণা ৪২০ থেকে ৩১৮, মানহানি ৪৯৯ থেকে ৩৫৬ ইত্যাদি।

আইন শৃঙ্খলা ও শান্তি রক্ষার প্রয়োজনে দেশে সুসংহত অপরাধমূলক আইন থাকা জরুরি। কিন্তু সেই আইন কখনও নাগরিকদের সাংবিধানিক অধিকার হরণ করতে পারে না। গণতান্ত্রিক রাষ্ট্রব্যবস্থায় বাকস্বাধীনতা ও মুক্ত চিন্তার পরিসরে আইন বাধা সৃষ্টি করতে পারে না। কিন্তু নতুন ফৌজদারি আইনের অন্যতম লক্ষ্য হল বিরোধী কণ্ঠস্বরকে জব্দ করা। কারণে অকারণে একজন নাগরিকের আইনের চোখে অপরাধী হয়ে যাওয়ার আশঙ্কা রয়েছে। পান থেকে চুন খসলেই বিপদ! আসলে নাগরিক সমাজকে আইনের ভয় দেখিয়ে সন্ত্রস্ত করে তোলার কৌশল গ্ৰহণ করা হয়েছে। পেশাগত দাবিতে, রাজনৈতিক বক্তব্যের প্রচারে, সরকারের জনস্বার্থ বিরোধী সিদ্ধান্তের বিরুদ্ধে আন্দোলন গড়ে তোলার অধিকার খর্ব করতে চাওয়া হয়েছে। সমাজের শিক্ষিত শুভবুদ্ধিসম্পন্ন প্রগতিশীল চিন্তাবিদদের উগ্ৰ সাম্প্রদায়িক সমাজবিরোধী মানবতাবিরোধী জঙ্গি সন্ত্রাসীদের সঙ্গে একাকার করে দিয়ে শাস্তি প্রদানের ব্যবস্থা করা হয়েছে। আইনের সাহায্যে আরও বেশি করে রাজনৈতিক প্রতিহিংসার পথকে প্রশস্ত করা হবে। বিরোধী দলের নেতাকর্মীদের শাসকদলে আসতে বাধ্য করা হবে। বিগত এক দশকে এমন ভুরিভুরি দৃষ্টান্ত দেখা গেছে, বিরোধী দলে থাকার সময় যে ব্যক্তি ছিল কয়লার মতো কালো সেই ব্যক্তি শাসকদলে যোগদান করে হয়ে গেছে দুধের মতো ধবধবে সাদা।

নতুন আইনে বিভিন্ন অপরাধের শাস্তিকে আরও কড়া ও কঠিন করা হয়েছে। যেমন, মৃত্যুদণ্ডের প্রাবল্য বৃদ্ধি পেয়েছে।আইপিসি'তে মৃত্যুদণ্ডের বিধান ছিল ১১টি ক্ষেত্রে, বিএনএস-এ তা হয়েছে ১৫টি। অথচ বিরলের মধ্যে বিরলতম অপরাধের ক্ষেত্রেই মৃত্যুদণ্ডের কথা ভাবা হয়ে থাকে।আধুনিক বিশ্বে মৃত্যুদণ্ড বিলোপের জনপ্রিয় দাবির কথাও বিস্মৃত হওয়া উচিৎ নয়।অনেকগুলো ক্ষেত্রে কারাবাসের মেয়াদ বাড়ানো হয়েছে।এখন থেকে যাবজ্জীবন কারাদণ্ডের অর্থ হল আমৃত্যু কারাবাস। চোদ্দো বছর কারাদণ্ড ভোগের পর বন্দির আচার আচরণ বিবেচনা করে মুক্ত করার যে রীতি ছিল তা রদ করা হয়েছে। জরিমানার পরিমাণ বহু গুণ বৃদ্ধি করা হয়েছে। নতুন আইনের 'ন্যায়' আর 'নাগরিক সুরক্ষা' জেল, জরিমানা ও মৃত্যুদণ্ডের বহর দেখে লজ্জা পাচ্ছে! আসলে নতুন আইনে দেশের সর্বোচ্চ আইন তথা সংবিধানের মৌলিক ভাবনাকে অস্বীকার করতে চাওয়া হয়েছে।

ন্যায় সংহিতার ১১১ নম্বর ধারায় যেভাবে 'সংগঠিত অপরাধ'কে সংজ্ঞায়িত করা হয়েছে তাতে জরুরি পরিষেবায় বাধাদানের অভিযোগ তুলে যেকোনো গণআন্দোলনের শীর্ষ নেতৃত্বের বিরুদ্ধে আইনি ব্যবস্থা নিয়ে যাবজ্জীবন কারাদণ্ডে দণ্ডিত করে দেওয়া সম্ভব। এর ফলে শ্রমিকদের দাবি-দাওয়া আদায়ের আন্দোলন করার সাংবিধানিক অধিকার ক্ষুণ্ন হবে।

ইউএপিএ,২০১৯ (আন-লফুল অ্যাক্টিভিটিজ প্রিভেনশন অ্যামেন্ডমেন্ট অ্যাক্ট) একটি দমনমূলক আইন। বেআইনি কার্যকলাপ প্রতিরোধ করার কথা বলা হলেও মুক্তচিন্তার কণ্ঠস্বরকে জব্দ করার জন্য বহু বিশিষ্ট ব্যক্তির বিরুদ্ধে এই আইনের অধীনে মামলা দায়ের করা হয়েছে। তাঁদের বিনা বিচারে অনির্দিষ্টকাল জেলের ঘানি টানতে হচ্ছে। ইউএপিএ থাকছেই, এবার সন্ত্রাসবাদী কার্যকলাপকে আরও কঠোর ভাবে মোকাবেলা করার সংস্থান রাখা হয়েছে বিএনএস-এর ১১৩ নম্বর ধারায়। সর্বোচ্চ শাস্তি যাবজ্জীবন কারাদণ্ড থেকে মৃত্যুদণ্ডও হতে পারে। এই আইনে সমাজের প্রতিষ্ঠিত শিক্ষাবিদ, চিন্তাবিদ, সমাজকর্মী ও মানবাধিকারকর্মীদের ফেঁসে যাওয়ার আশঙ্কা রয়েছে।

আইপিসি'র ১২৪এ ধারা ছিল রাষ্ট্রদ্রোহিতা (সেডিশন) সম্পর্কিত। সর্বোচ্চ শাস্তি ছিল সাত বছরের কারাবাস। ব্রিটিশ সরকার ভারতের স্বাধীনতা আন্দোলনের শীর্ষ নেতৃবৃন্দকে এই ধারায় অভিযুক্ত করে কারাবন্দি করত। নতুন ফৌজদারি আইনে সরাসরি রাষ্ট্রদ্রোহিতার কথা নেই। কিন্তু বিএনএস-এর ১৫২ ধারায় যা রয়েছে তা আরও মারাত্মক।এই ধারা অনুযায়ী, কোনো ব্যক্তির কথা, লেখা, ছবি বা অন্য কোনো যোগাযোগ বিচ্ছিন্নতাবাদী কার্যকলাপে উস্কানি দিচ্ছে অথবা দেশের সার্বভৌমত্ব, একতা ও অখণ্ডতাকে বিপন্ন করতে প্ররোচনা যোগাচ্ছে বলে মনে হলে সেই ব্যক্তি অভিযুক্ত হবেন। শাস্তি হতে পারে যাবজ্জীবন কারাদণ্ড। সরকারের অথবা শাসকদলের বিরুদ্ধে আপসহীন মনোভাব নিয়ে চলতে থাকা যেকোনো বিশিষ্ট ব্যক্তিকে এই ধারায় ধরে তাঁর প্রতিবাদী কণ্ঠস্বরকে স্তব্ধ করে দেওয়ার জোরালো আশঙ্কা রয়েছে।

নতুন ফৌজদারি আইনে পুলিশ প্রশাসনের গুরুত্ব বৃদ্ধি করা হয়েছে। গ্ৰেফতার হওয়া ব্যক্তিদের পুলিশ হেফাজতের মেয়াদ অনেকটাই বাড়ানো হয়েছে। এর ফলে পুলিশ হেফাজতে শারীরিক ও মানসিক নির্যাতন আরও বাড়বে বলে মনে হয়। তদন্ত প্রক্রিয়ার উপরেও গোপন বোঝাপড়ার প্রভাব পড়তে পারে। গণতান্ত্রিক সভ্য সমাজে পুলিশি রাষ্ট্র শোভা পায় না।

বিচার প্রক্রিয়ার দীর্ঘসূত্রিতা দূর করার ক্ষেত্রেও নতুন আইন কার্যকর ভূমিকা নিতে পারবে বলে মনে হয় না। প্রথম শুনানির ৬০ দিনের মধ্যে চার্জ গঠন এবং শেষ শুনানির ৪৫ দিনের মধ্যে রায় ঘোষণা করার কথা বলা হয়েছে। কিন্তু শুনানির সর্বোচ্চ সংখ্যা কিংবা প্রথম শুনানি ও শেষ শুনানির মধ্যে সময়ের সর্বোচ্চ ব্যবধানের ব্যাপারে নির্দিষ্ট ভাবে কিছু বলা হয়নি। অর্থাৎ 'তারিখ পে তারিখ' চলতেই থাকবে। 'জাস্টিস ডিলেইড ইজ জাস্টিস ডিনাইড'-এর অবসান ঘটবে না। টাকা যার বিচার তার, এই ধারণাও দূর হবে না।

আমাদের দেশের বিচার ব্যবস্থার সংস্কার দরকার। কিন্তু শুধুমাত্র ফৌজদারি আইনের কিছু অধ্যায় ও ধারার রদবদল ঘটিয়ে এই সংস্কার সাধন করা সম্ভব নয়। এর জন্য আদালতের সংখ্যা বাড়াতে হবে। পর্যাপ্ত পরিমাণে বিচারপতি ও আদালতের কর্মচারী নিয়োগ করতে হবে। পুলিশের কাজ ভাগ করে দিতে হবে। কেউ আইনশৃঙ্খলা রক্ষা করবে, কেউ তদন্তের কাজে নিয়োজিত থাকবে। আইন নিরপেক্ষ তথা 'অন্ধ' থাকবে।পক্ষ যদি নিতেই হয় তবে দুর্বলের পক্ষ নিতে হবে।মাধ্যমিক স্তরের পাঠক্রমে বিচার ব্যবস্থা সম্পর্কিত আলোচনা অন্তর্ভুক্ত করা হোক। আইন সম্পর্কে সচেতনতা কম বয়স থেকেই গড়ে উঠুক।

জাতি সত্তা, ভাষা সত্তা ও ধর্ম নিরপেক্ষতা, এই তিনটি বিষয় নিয়ে গোটা বিশ্ব আজ তোলপাড়। তোলপাড় আমাদের এই ভারতীয় উপমহাদেশ। সমস্ত মৌলবাদীরা কি ধর্মীয় মৌলবাদী, কি ভাষাগত মৌলবাদী, কি জাতিগত মৌলবাদী, সমস্ত মৌলবাদী শক্তিগুলিই আজ দেশে দেশে সভ্যতা, সংস্কৃতি ও মানবতার সামনে এক গভীর চ্যালেঞ্জ হিসাবে আত্মপ্রকাশ করেছে। এই প্রেক্ষাপটে এই উপমহাদেশে তথা অবিভক্ত ভারতের ধর্মনিরপেক্ষতা, জাতি সত্তাগত স্বাতন্ত্র্য ও ভাষাগত স্বাধিকারের আপোষহীন সংগ্রামী বরেণ্য ভাষাতত্ত্ববিদ ডঃ শহীদুল্লাহকে স্মরণ করতে চাই। ইংরেজ শাসনাধীনে ১৮৮৫ সালের ১০ই জুলাই তিনি অবিভক্ত বাংলার অধুনা পশ্চিমবাংলার পেয়ারা গ্রামে জন্মগ্রহন করেন এবং ১৯৬৯ সালের ১৩ই জুলাই তৎকালীন পূর্ব্বপাকিস্থানের ঢাকায় মৃত্যু বরণ করেন। শৈশব থেকেই ডঃ শহীদুল্লাহ ছিলেন একজন সংস্কারমুক্ত মানুষ। এবং বলা যায় যে তিনি ছিলেন চিন্তায় ও ভাবনায় গতানুগতিকতা বিরোধী একজন বিপ্লবী চেনতার অনন্য সাধারণ মানুষ। সাধারণের মধ্যে আজও প্রকাশ্যে--অপ্রকাশ্যে এই ভ্রান্ত ধারণা রয়েছে যে সংস্কৃত হোল বেদ--বেদান্তের ভাষা, দেব-ভাষা, হিন্দুদের ভাষা। আর আরবী হোল কোরাণ ও হাদিসের ভাষা, ইসলামের ভাষা। স্বভাবতঃই মুসলিমরা পড়বে আরবী, হিন্দুরা পড়বে সংস্কৃত। ডঃ শহীদুল্লাহ এই গতানুগতিক ভ্রান্ত ধারণাকে দুপায়ে দলে পিষে, অসাম্প্রদায়িক ও ধর্মনিরপেক্ষ অবস্থান লেন এই ক্ষেত্রে। তাঁর বক্তব্য ছিল যে ভাষা কোন বিশেষ ধর্মের বা কোন জাতির বিষয় নয়। ভাষা হোল বেগবতী নদীর ধারার মত। ধর্ম দিয়ে বা জাতপাত দিয়ে তাকে বাঁধা যায় না। এই বাঁধার চিন্তাটাই হোল নির্বোধের হাস্যকর প্রয়াস মাত্র। এই অবস্থান থেকে ডঃ শহীদুল্লাহ সংস্কৃত ভাষা নেন স্নাতক ও স্নাতকোত্তর স্তরে। মৌলবাদী হিন্দু ও মৌলবাদী মুসলিমরা এতে রে রে করে ওঠে। একদিকে উলেমাপন্থীরা অর্থাৎ মুসলিম মৌলবাদীরা বলতে থাকেন--"মুসলিম ঘরের একটি মেধাবী-উজ্জ্বল সন্তান, সে কোথায় আরবি নিয়ে পড়বে এবং বড় হয়ে ইসলামী ভাবধারা ও ইসলামী সংস্কৃতি চর্চায় মূল্যবান অবদান রাখবে, তা না করে সে কিনা বেদ বেদান্ত উপনিষদের ভাষার দিকে, হিন্দুদের ভাষার দিকে ঝুঁকেছে ও ঝুঁকছে। কোন মোমিন ভাই কি এটা মানতে পারে?

অন্যদিকে, গোঁড়া হিন্দুরা, বিশেষ করে সংস্কৃত পণ্ডিতরা বলতে থাকেন--সংস্কৃত পড়বে হিন্দুরা। তারা এটা পড়ে হিন্দু সংস্কৃতিকে জানবে ও বুঝবে। তা না করে কিনা মুসলিম ঘরের ছেলেরা সংস্কৃত শিখবে! এ অসহনীয়। এ মানা যায় না। হিন্দু ধর্মের তথা দেবভাষা সংস্কৃতের পবিত্রতা এতে বিনষ্ট হবে। শহীদুল্লাহর এই স্পর্ধাকে রুখতেই হবে।

শেষ পর্যন্ত, কোলকাতা বিশ্ববিদ্যালয়ের উপাচার্য স্যার আশুতোষ মুখার্জী আসরে নামেন। হিন্দু মৌলবাদী ও মুসলিম মৌলবাদী উভয় মৌলবাদী শক্তিকে ক্ষুরধারভাষায় তিনি আক্রমণ করেন এবং বলেন যে কোন ভাষা কোন বিশেষ ধর্মীয় গোষ্ঠীর লোকদের পৈত্রিক সম্পত্তি নয়। সব ভাষার দ্বার সবার কাছে উন্মুক্ত। যে কেউ যে কোন ভাষা নিয়ে চর্চা করতে পারে--এটা তার জন্মগত অধিকার। ধর্মের দোহাই পেড়ে কেউই এক্ষেত্রে কারোর আগ্রহকে দমিত করতে পারে না। দমন করার বা বাধা দেবার কোন চেষ্টা হোল একটি দানবীয় বর্ব্বরতা। এইভাবে স্যার আশুতোষ মুখার্জীর বলিষ্ঠ হস্তক্ষেপে ছাত্র শহীদুল্লাহ সংস্কৃত নিয়ে পড়ার সুযোগ পান। সাম্প্রদায়িকতাবাদী মৌলবাদী হিন্দু ও মুসলিমরা লেজ গোটাতে বাধ্য হয়।

ধর্ম নিরপেক্ষতার পথে তথা ভাষাগত প্রশ্ন নিয়ে তরুণ শহীদুল্লাহর এইভাবে চলা শুরু। তিনি বাংলা, উর্দূ, আরবি, সংস্কৃত, ইংরাজী সহ ২৪টি ভাষা রপ্ত করেছিলেন। এর মধ্যে ১৬টি ভাষায় তিনি ছিলেন ভীষণ তুখোড়। সাবলীল ভাবে লিখতে, পড়তে, কইতে পারতেন--তাঁর এই ভাষাগত বহুমুখীতা তাঁকে সমস্ত সংকীর্ণতার ঊর্ধ্বে তুলেছিল। তিনি ছিলেন এক সাত্ত্বিক সুন্নী মুসলিম। কিন্তু, কোন ধর্মীয় সংকীর্ণতা তাঁর মনটাকে কলুষিত করতে পারেনি। শিয়া, সুন্নী, হিন্দু, মুসলিম, খৃশ্চান, সকল ধর্মের সকল মতের মানুষের প্রতি তিনি ছিলেন শ্রাদ্ধাশীল। অন্যভাবে বলতে গেলে বলা চলা যে বিবিধ ভাষার চর্চা তাঁকে একজন উদার আন্তর্জাতিকতাবাদী তথা বহুত্ববাদী মানুষে পরিণত করেছিল।

পরাধীন ভারতবর্ষে জন্মে মাতৃভূমির মুক্তির জন্য তাঁর যে দায়, তা তিনি অক্ষরে অক্ষরে পালন করেছেন। আমরা আগেই উল্লেখ করেছি যে মুসলিম মৌলবাদী উলেমা ও হিন্দু মৌলবাদী পণ্ডিতদের সমস্ত বাধাকে উপেক্ষা করে স্যার আশুতোষ মুখোপাধ্যায়ের অকুতোভয় হস্তক্ষেপে তিনি কিভাবে সংস্কৃত নিয়ে উচ্চশিক্ষার সুযোগ পেয়েছিলেন। এই লড়াই একদিকে তাঁর ধর্মনিরপেক্ষতার ভিতকে আরো শক্তপোক্ত করেছিল। অন্যদিকে স্যার আশুতোষ মুখোপাধ্যায় সম্পর্কে তাঁর শ্রদ্ধা গভীরভাবে বেড়ে গিয়েছিল। তবে একটি বিষয় তাঁকে আমরণ পীড়া দিয়েছে তা হোল এই যে স্যার আশুতোষ মুখোপাধ্যায়ের মত একজন আপোষহীন ধর্মনিরপেক্ষ মানুষের সন্তান হলেন শ্যামাপ্রসাদ মুখোপাধ্যায়, যিনি ছিলেন সাম্প্রদায়িক মুসলিম লীগের প্রতিদ্বন্দ্বী সাম্প্রদায়িক হিন্দু মহাসভার নেতা। ডঃ শহীদুল্লাহ মনে করতেন যে এই দুই অশুভ শক্তির দ্বন্দ্ব বিবেকানন্দ--রবীন্দ্রনাথ--নজরুলের বাংলাকে দ্বিখণ্ডিত করেছে।

স্মরণ রাখা দরকার যে একজন ধর্মনিরপেক্ষ ও বহুত্ববাদী ভাবনার ভাষাবিদ হিসাবে তাঁর সকল ধর্ম ও সকল ভাষার প্রতি সম মর্যাদা বোধ ছিল। কিন্তু, এতদৃসত্ত্বেও তিনি জাতি সত্তার প্রশ্নে ছিলেন আপোষহীন। ধর্মের ভিত্তিতে জাতপাত বিভাজনকে তিনি ধিক্কার দিয়েছেন। এই জন্যেই তিনি জিন্না ও ইকবালের সঙ্গে সহমত হতে পারেননি। তিনি তাই মুসলিম লীগে না গিয়ে জাতীয় কংগ্রেসে যোগ দেন। তাঁর দৃষ্টিতে জাতিসত্তা চিহ্নিত করার মানদণ্ড মোটেও ধর্ম নয়, সেটা হোল ভাষা ও সংস্কৃতি। তাই তিনি বলতেন আমরা হিন্দু হই, মুসলিমই হই, যাই হই না কেন, সবার আগে আমরা বাঙালী। এই বাঙালী জাতিসত্তার প্রশ্নে তিনি ছিলেন লৌহদৃঢ়। তিনি ছিলেন এর অতন্ত্র প্রহরী।

অন্যভাবে বলতে গেলে বলা চলে যে ডঃ শহীদুল্লাহ মোটেও উগ্র বাঙালীয়ানার প্রবক্তা ছিলেন না। তিনি সব ভাষার প্রতি ছিলেন সমানভাবে শ্রদ্ধাশীল। কিন্তু, এই শ্রদ্ধা জানাতে গিয়েও তিনি সব সময় মনে রাখতেন ও অন্যকে মনে করিয়ে দিতেন যে তিনি একজন বাঙালী, বাংলা তাঁর মাতৃভাষা এবং বিবেকানন্দ--রবীন্দ্রনাথ--নজরুলের আদর্শপুষ্ঠ বাঙালী সংস্কৃতির তিনি একজন অন্যতম ধারক ও বাহক। তাই পরাধীন ভারতবর্ষে রাষ্ট্র ভাষার প্রশ্নে কংগ্রেস ও মুসলিম লীগের বিতর্কে যুক্তি ও আবেগ উভয় দিয়েই বোঝানোর চেষ্টা করেন যে উর্দূ বা হিন্দী অবশ্যই সমৃদ্ধ ভাষা। কিন্তু বাংলা ভাষার সঙ্গে সমৃদ্ধির কষ্টিপাথরের বিচারে এই দুই ভাষার স্থান অনেক অনেক পরে। জিন্না ও ইকবালকে তিনি ভাষার বিবর্তনের তথ্য দিয়ে বোঝানোর চেষ্টা করেন যে জন্ম ও সমৃদ্ধির ক্ষেত্রে উর্দূ ও হিন্দী বাংলার কাছে বহুগুণে ঋণী। কাজেই উর্দূ বা হিন্দী নয় বাংলাকে রাষ্ট্রভাষা করলে ইতিহাসের সঙ্গে সুবিচার করা হবে।

কবিগুরু রবীন্দ্রনাথ, গান্ধীজী, ও সীমান্ত গান্ধী খান আব্দুল গফুর খান জাতীয় কংগ্রেস বনাম মুসলিম লীগের রাষ্ট্র ভাষাগত বিতর্কে ডঃ শহীদুল্লার অবস্থানকেই সমর্থন করেছিলেন। গান্ধীজী, সীমান্ত গান্ধী, শরৎচন্দ্র বসু ও কমিউনিস্ট নেতা সোমনাথ লাহিড়ী প্রমুখদের তীব্র বিরোধীতা সত্ত্বেও যখন দেশ বিভাগ অনিবার্য হয়ে উঠলো, তখন ইকবালের দেওয়া পাকিস্থান শব্দটিতে তীব্র আপত্তি জানিয়ে ডঃ শহীদুল্লাই বলেন যে খণ্ডিত বাংলার পূর্ব্ব অংশকে পূর্ব্ব পাকিস্থান না বলে তাকে পূর্ব্ববাংলা নামকরণ করা হোক। কিন্তু, উগ্র ভাষাগত মৌলবাদীরা তাঁর এই প্রস্তাব মানেননি। ১৯৪৮ সালে তিনি ঢাকাতে ধীরেন্দ্রনাথ দত্ত প্রমুখদের সঙ্গে মিলিত হয়ে একটি সংগঠন তৈরী করেন যার লক্ষ্য হয় পূর্ব্ব পাকিস্থান নামকে পরিবর্তন করে পূর্ব্ববাংলা রাখা এবং বাংলা ভাষা ও বাঙালী সংস্কৃতির অস্তিত্বকে রক্ষা করা।

পাকিস্থান কর্তৃপক্ষ ডঃ শহীদুল্লাকে পাকিস্থান উর্দূ একাডেমির সভ্য করে। সেখানেও তিনি বাংলা, উর্দূ, বেলুচি, পাঞ্জাবী সহ বিভিন্ন ছোট ছোট "Dialects" বা উপভাষা ও সংস্কৃতি সমূহের সম মর্যাদা ও সমবিকাশের কথা বলেন। কিন্তু পাক কর্তৃপক্ষ তাঁর সে কথায় কর্ণপাত করেননি। সব চাইতে গুরুত্বপূর্ণ বিষয় হোল এই যে অবিভক্ত পাকিস্থানে জনসংখ্যার সিংহভাগই বাংলায় কথা বলতেন। স্বভাবতঃই বাংলাই অবিভক্ত পাকিস্থানের রাষ্ট্রভাষা হওয়া উচিৎ বলেই অনেকের মত ডঃ শহীদুল্লাহও মনে করতেন। কিন্তু পাক শাসক গোষ্ঠী সে কথায় কোন গুরুত্বই দেননি--তার পরিণতি আমাদের সকলেরই জানা।

মোট কথা, জাতি সত্তা, ভাষা সত্তা ও ধর্ম নিরপেক্ষতার প্রশ্ন নিয়ে উপমহাদেশীয় লড়াই বা বিশ্ব জোড়া লড়াই দীর্ঘদিনের এবং সেই লড়াইয়ে নমস্য একাধিক নামের মধ্যে ডঃ শহীদুল্লাহও একটি সম্মানিত ও সর্ব্বজন শ্রদ্ধেয় নাম। সারা পৃথিবীতে, বিশেষ করে ভারত, পাকিস্থান ও বাংলাদেশে এই তিনটি বিষয়ই আজ বিপন্ন। বিশেষ করে আমাদের দেশে, অশোক, আকবর, দারাশিকো, রবীন্দ্রনাথ, নজরুলের দেশে হিন্দু ও মুসলিম উভয় মৌলবাদ, এবং উগ্র হিন্দী আধিপত্যবাদ আমাদের দেশের ধর্মনিরপেক্ষতা, ছোট বড় সকল জনগোষ্ঠীর জাত সত্তা ও ভাষাগত সত্তাকে বিপন্ন করছে। এর বিরুদ্ধে জাতি ধর্মনির্বিশেষে সকল শুভবুদ্ধি সম্পন্ন মানুষকে ঐক্যবদ্ধভাবে লড়তে হবে এবং ধর্মনিরপেক্ষতা, প্রত্যেক জনগোষ্ঠীর জাতি সত্তা ও ভাষাগত সত্তাকে রক্ষা করতে হবে, এটাই হোল ডঃ শহীদুল্লাহর প্রয়াণ দিবসে তথা প্রয়াণ পক্ষে সময়ের দাবী।

The Whispers of Indus River

Rambling along the banks of Indus River

I heard the whisperings.

"I'm the river, once called the Mighty Indus"

"Have a look at me. Am I still the Mighty?"

Sand dunes have emerged in my wide riverbed

Whirlwinds are there

Where once used to be whirlpools.

Look around you O' man

You will see the withering leaves

Of dried up trees

And the wilting plants

Across the farmlands

The humans and animals

Wandering for the water

To quench their thirst.

Don't you know O’ man?

The groundwater has

Turned arsenic

The forests and wildlife are fast vanishing

The entire ecosystem has been destroyed

In my lower riparian region

Creating the food insecurity

Posing the threat of a famine-like situation.

It was me, the Mighty Indus

Which gave birth to a great civilization

People worshiped my jewel-blue stream

While I hopped over the rocks happily

Emanating from the Himalayas

Flowing down thousands of kilometers

Traversing the mountains and plains

To meet the Sindhu Sagar, the Ocean

And the Rig-Veda, ancient Vedic Sanskrit hymns

Were composed sitting at my banks.

Are you listening to my whispers O’ man?

It was me, the Mighty Indus

That flowed down splashing

And curving gently through the forests along my banks

The people used to come for pilgrimage

And take a drink finding my water very refreshing.

The aroma of the forest was great.

Have a look at me, the Mighty River - the lifeline

Of hundreds of millions of souls

But you will now find only a dried up river.

Listen to me O’ man!

Scientists say, the glaciers are melting fast

Due to global warming

Causing the floods in the rivers.

If, it’s so,

Why there are no floods?

And the drought prevails in the lower riparian region

My Delta has been destroyed and the Ocean is intruding

Devastating the fertile lands and crops

And causing the extinction of marine life

Snatching the source of livelihood of millions of souls.

Let me tell you the truth O’ man!

The avaricious humans have built dams and barrages

And the Link Canals upstream

To block my flow towards the Ocean

And cultivate their own lands

Despite knowing they are working

Against the nature, ravaging this part of planet

But unknowing that the Nature will retaliate one day

And ruin them too.

Unrequited Love

Nightingale sings the melodious songs at night

For her longing, love, and connection to the moon

Being a symbol of life, hope, eternity, and love,

The peace, prosperity, and reunion with loved-one.

Deep into full moon night,

Chakor too sheds its tears in longing,

Releasing the song of unrequited passion,

For its alluring beloved - the moon

Unattainable high in the skies.

He takes flight in a bid to meet the moon

But falls back to earth before the day break.

The love of Nightingale, and the Chakor

For the moon, remains unrequited

The moon itself shines by reflecting sunlight

Continuing its journey

Unaware of the loving birds of planet Earth.

So is my love for

The nature, people, humanity, cultures

And languages of the world.

Unlike the Nightingale and Chakor

I don't wait for the full moonlight

And sing the songs of love and peace all the time

Being first and the last love of my life

No matter it's unrequited.

Dreams of Revolution and Freedom

What is the significance of dreams seen after sleep?

Dreams should be those that do not let you sleep.

I also keep seeing such dreams, like an old saying,

Dreams of economic, social revolution and national unity

That have not allowed me to sleep all my life.

But despite not realizing it in seven decades,

I have not stopped seeing such dreams.

Some of them are lying under the bed in my place, on which I sleep with my head every day,

Some of them are kept in the small cupboard next to it,

And some of them are lying between the pages of books.

Every night by opening the closet, laying my head on the bed or opening a book,

I go back to the world of these dreams.

Journalist, Author, Researcher and Poet

Nasir Aijaz, based in Karachi, the capital of Sindh province of Pakistan, is basically a journalist and researcher having spent over 48 years in the field of journalism. He won Gold Medal and another award for best reporting in 1988 and 1989. He has worked in key position of editor for newspapers and news agencies. He also worked as a TV Anchor (For Pakistan Television) for over a decade and conducted some 400 programs from 1982 to 1992 besides appeared as analyst in several programs on private TV channels. He also did dozens of programs on Radio Pakistan and some other private Radio channels. He is author of nine books on history, language, literature, travelogue and biography. One of his books ‘Hur – The Freedom Fighter’, a research work on war against the British colonial forces, also won a prize. Some of his other books are unpublished. Further, he translated a poetry book of Egyptian poet Ashraf Aboul Yazid, into Sindhi language, which was published in Egypt. Besides, he has written around 500 articles in English, Urdu and Sindhi, the native language of Sindh. He is editor of Sindh Courier, an online magazine and represents The AsiaN, an online news service of South Korea with regular contribution for eleven years. His articles have also been translated in Arabic and Korean languages. Some of his English articles were published in Singapore and India and Nigeria. He writes poetry in his native language Sindhi, and English. Very recently, some of his poems have been translated in Albanian, Italian and Greek languages and published there besides in Arabic language published in Egypt and Abu Dhabi. His English poems have also been published in Bangladesh, Kosovo, USA, Tajikistan, Greece, Italy and some other countries. Nasir Aijaz is one of the founding members of Korea-based Asia Journalists Association AJA. He has visited some ten Asian countries and attended international seminars.

But they are all so different

They, the roses, have their thorns

And without a doubt they are all so beautiful

And every bird, with its feathers

That some of them don't know how to fly

And the sun, which you never touched

beautiful and hides beyond the sea

It's for life, with its distinctions

Beauties that looks reflect

Because the hearts of men

They oppose but resemble each other

I would say, but it's not possible, "I have a thousand sins against you in my heart.

If I were to tell you my biggest secret, "loving you is a crime", then I'm a stinker.

I would tell you how much it hurts, that my words are lies and you don't believe me.

I would say the secret is you "you haven't noticed my biggest secret.

I would like to tell you all the secrets of the night.

I would say so, but I dare not.

I would like to say that my heart is not a lying bridge, just say all the words.

I would say that I am here "dreams escape me" because

The flame does not rest "it just burns" but you wouldn't believe me if I said that.

You are the fire in my heart, you are the true happiness.

You are the sun in my soul," I would say.

You are the ice in my heart " melt it or let it go forever.

I would say so.

APPRECIATE IF HE IS HARD-WORKING AND SMART

Befriend anyone you know

Appreciate if he/she is hardworking and smart

A friend cannot replace a hand

If he is foolish, condemn him too.

For some reason he doesn't touch anything.

He doesn't care if he doesn't interfere

Skilled but not trying

If he is smart and lazy, be patient

Right and left have a lot of share

It's like a Bolu Bey in those mountains

One advice is better than a thousand nusubets

If he is mindless and lazy, explain a little

Don't let humanity eat you.

Hand, wish, waist, if you're attached

You see that he is a hardworking, good person.

If he is a man who knows how to do business, hire him and give him command.

While it is often seen in public places

While Yusuf was always upset about this,

While being smart and hard-working

If it's not one of them, grab it and bounce it

Thinking that every bad person is dead,

In the crucible of existence, we forge our souls,

Anvils of adversity shaping us whole.

Life's chisel carves our edges, sharp and keen,

As we dance with shadows, unseen.

The sun kisses our scars, a mosaic of pain,

Each fracture a testament to battles fought in vain.

Yet, behold the beauty in our fractured hearts,

For strength blooms from shattered parts.

Storms rage, winds howl, and tides pull us under,

But we rise, phoenix-like, from the thunder.

Embrace the tempest, let it cleanse your core,

For resilience blooms in life's relentless war.

So let us honor the struggle, the ache, the strife,

For within those depths, we discover life.
